Are house plans copyrighted?

All house plans available on Professional Home Plans are copyrighted under federal copyright laws. Unauthorized reproduction, modification, or reuse of the plans or designs is strictly prohibited without written consent from Professional Home Plans. This includes all aspects of the plan, such as 2D artwork, 3D artwork, floorplan artwork, and technical drawings.


Can I change a plan without violating copyright?

It is important to note that making changes to or redrawing a plan found in a plan book is also considered a violation of copyright. The right to modify plans is one of the exclusive rights of copyright. It is also illegal to copy or redraw a constructed home that is protected by copyright, even if the plans for the home have never been seen before. Therefore, it is necessary to purchase a set of plans from an authorized source if you find a plan you like.


Can I build the same plan more than once?

Professional Home Plans offers a single-use license as the default license type for building plans. This license permits the builder to construct the home from the plans only once. Building the same plan multiple times without obtaining an unlimited build license is considered copyright infringement.


Can I make copies or print from the PDF?

Reproducible PDF copies of plans are provided with every purchase. However, it is important to note that only the purchaser is allowed to build a home from the plans according to their construction license. Making modifications to the plan using CAD files does not remove the copyright from the original author, and modified plans cannot be reused or resold without Professional Home Plans' permission.


Who is responsible for copyright infringement?

Any party involved in a copyright violation may be held responsible, including purchasers, designers, architects, engineers, drafters, homeowners, builders, contractors, sub-contractors, copy shops, blueprints, developers, and real estate agencies. Ignorance of the law is not a valid defense.

Penalties for copyright infringement may be severe, including payment of actual damages, profits made by the infringer, statutory damages of up to $150,000 for each infringement, and legal fees.
