This Privacy Policy describes our practices in connection with the collection use and disclosure of personal information through the website(s) operated by PROFESSIONAL DESIGN SERVICES, LLC DBA PROFESSIONAL HOME PLANS (“PHP”) at which this Privacy Policy is posted (the “Site”), as well as other personal information we collected from and about you in other contexts. With respect to PHP’s online collection of personal information, this Privacy Policy applies only to the Site and not to any third-party websites that may be accessible from the Site. This Privacy Policy also describes PHP’s offline personal information collection and use practices, and the practices PHP employs when collecting personal information online through means other than the Site (for example, if you send PHP an e-mail).

Please be sure to read this Privacy Policy before using the Site or submitting information through the Site. This Privacy Policy is current as of the Effective Date above but may change from time to time, so please check this Privacy Policy periodically for updates. If PHP makes any substantive changes to this Policy, PHP will announce it on this Site. Once the changes have been made, your continued use of the Site will constitute your acceptance of the revised Privacy Policy.

What information does PHP collect and how is it used?

With respect to PHP’s online collection of personal information, the Site collects information in several areas, including for magazine subscription pages, trade show registrations, bookstore transactions, newsletter sign up pages, website registrations, and online surveys. The information PHP requests for you to participate in these features may include personal information (that is, any information, in digital, hard copy, or other forms, that can be used alone or together with other information to directly or indirectly identify a specific individual or household). “Personal information” as used in this Privacy Policy includes pseudonymized, encrypted. It does not include deidentified or aggregated data. PHP and the Site collects the below categories of information:

Contact information, such as name, address, location, email, and telephone number;

Online identifiers, such as IP address, cookies, username, and password;

Commercial information, such as property records, deed or title information, or other purchase histories, not collected from publicly available government records;

Professional, employment, or education information, such as copies of your resume or CV and any other information required to verify your qualifications, for recruitment purposes;

Visual, electronic, or similar information such as images; and

Financial information, such as credit card information, for paid online accounts.

The information PHP collects is used to provide you with services from PHP, respond to your specific requests, to send you periodic information and special offers from PHP and/or PHP’s affiliates, to provide you with updates on PHP offerings and features, to provide you with product information from manufacturers in PHP’s database, to provide notice of changes to PHP’s Terms and Conditions of Use and Privacy Policy, to provide PHP’s affiliates and business partners with data about PHP’s users to analyze Site usage and improve the services offered, and to detect and protect against error, fraud or other criminal activity. The information you provide is also used to understand users’ interests and behavior, and may be combined and analyzed with information PHP may have from other online or offline sources for marketing or other purposes.

As you navigate through the Site, certain information can be passively collected (that is, gathered without you actively providing the information) using various technologies and means. Like most website operators, PHP uses cookies, web beacons, log files, and other electronic information collection mechanisms to track IP addresses and gather certain information from website users. IP addresses are collected for system administration purposes and for studying how people use the Site and how the Site can be improved. When you use the Site, PHP may record information about your usage of the Site, such as by using the Site’s groups, forums, or blogs and/or uploading images or photos. If you are logged into the Site, PHP may associate the login information with your account information. In order to ensure the quality of the Site’s services to you, PHP may place a tag (also called a web beacon) in HTML-based customer support e-mails to or other communications with you in order to confirm delivery. PHP uses cookies to identify registered Site users and to provide them with access to previously-stored information, and in the event special “member only” content areas that may include articles and reports, are created by PHP, cookies will also be used provide registered Site users access to the same. PHP also uses cookies to estimate audience size and usage patterns and to track the aggregate number of customer returns at the Site. Additionally, PHP uses cookies to help simplify the process of filling out certain forms on the Site that allow you to request information from manufactures in PHP’s catalog and/or PHP’s advertisers and/or affiliates. Finally, PHP uses Google Analytics and the information PHP receives from Google Analytics to improve the Site. Please refer to Google’s Privacy Policy for more information. You may also choose to download the Google Analytics opt-out browser add-on. You can choose whether or not you accept cookies by changing the settings of your browser. You can also manage many companies’ cookies used for online advertising via the consumer choice tools created under self-regulation programs in many countries, for example, the aboutads.info choices page. However, certain parts of the Site may not work if you turn off cookies on your browser.

With whom does PHP share your information?

PHP shares your information with PHP’s affiliates and business partners, including agents such as third-party mail processing facilities. PHP may employ contractors to help with PHP’s operations. Some or all of these contractors may access the databases of user information.

In limited circumstances, PHP may also share information about PHP’s subscribers with third parties in whose products or services PHP believes you may be interested or third parties who may be interested in your products or services. Subject to applicable law, PHP may sell, rent, license, trade or otherwise disclose your personal information, including but not limited to your mailing address, phone number, and other registration information, to third parties for marketing, merchandising, or other purposes, and you should presume that your personal information may thus be subject to future transactions.

PHP will also share your information if required or permitted by law to do so, to comply with applicable laws or valid legal process such as in response to a search warrant or other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, to protect the rights or property of PHP, or as otherwise may be required or permitted by applicable U.S. law, or other law or legal process, which may include lawful access by U.S. or foreign courts, law enforcement or other government authorities.

PHP may provide users with the opportunity to request additional information from product manufacturers in PHP’s online directory or from PHP’s advertisers and/or affiliates. If you specifically request information from a manufacturer or from one of PHP’s advertisers and/or affiliates, your contact information will be given to that manufacturer or advertiser, to allow them to decide the best way to fulfill your request. Some of PHP’s advertisers and/or affiliates may display ads on the Site that solicit, or contain technology to collect, information about PHP’s users. This information is collected and used by PHP’s advertisers and/or affiliates and is outside of PHP’s control. If you have any questions about an advertisement, you should contact the responsible advertiser directly.

What options do you have about how PHP uses or shares your information?

If you no longer wish for PHP to share your mailing address or other contact information with PHP’s advertisers and/or affiliates, or other third parties, please contact PHP here. For PHP to be able to locate your record, your message must include your name, mailing address, e-mail address, and must identify the PHP product, event, or service for which you are registered. PHP will then send you a Notification to Not Sell Personal Information, which you must complete and mail back to PHP. Once PHP receives your Notification to Not Sell Personal Information, PHP will endeavor to process your request within ten (10) days, and thereafter PHP will no longer share your contact information with third parties. Please note that PHP will not be able to stop third parties from sending you information about their products or services if your information was shared with them before PHP received your request. Regarding e-mail specifically, you have the opportunity to elect to stop receiving advertising messages from PHP about PHP’s products or services each time you receive such a communication from PHP. To unsubscribe from such advertising e-mail messages, please follow the “unsubscribe” directions included in that e-mail message. PHP will endeavor to process your request within ten (10) days. Please note that during that time, you may continue to receive e-mail messages from PHP about its products or services. Additionally, regardless of whether you have unsubscribed from receiving advertising and promotional material from PHP, you will continue to receive transactional information from PHP, such as information relating to your account or payment or bill information. If you receive broadcast e-mail messages that PHP may send about third-party manufacturers in whose products or services PHP believes you may be interested, and no longer wish to receive such messages, you can do so by following the “unsubscribe” directions included in the e-mail message you receive. If you have further questions regarding your options with respect to your account information, please contact PHP at the e-mail or mailing address included at the beginning of this Privacy Policy.

How does PHP respond to ‘Do Not Track’ signals?

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. PHP does not recognize or respond to browser-initiated DNT signals, as the Internet industry is currently still working toward defining exactly what DNT means, what it means to comply with DNT, and a common approach to responding to DNT.

What kind of security measures does PHP use?

PHP has put in place reasonable and appropriate administrative, physical, technical, and managerial procedures to attempt to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information PHP collects online. However, please remember that no transmission of data over the Internet or any wireless network can be guaranteed to be one hundred percent (100%) secure. As a result, while PHP strives to protect your personal information, PHP cannot ensure or warrant the security of any information that you transmit to PHP or from PHP, and you do so solely at your own risk. Once PHP receives your transmission, PHP uses commercially reasonable efforts to ensure its security on PHP’s systems. PHP, however, shall have no liability for disclosure of information obtained due to errors in transmissions or the unauthorized intervention of third parties.

Passwords may be used by the Site to protect your personal information. PHP recommends that you do not share your passwords with anyone, and notify PHP promptly if you believe your password security has been breached. PHP will never ask you for your password in an unsolicited phone call or in an unsolicited e-mail. Also, if you are using a computer that others have access to, such as one in a computer lab, Internet cafe or public library, always remember to log out and close your browser window when leaving the Site. In addition, any personal information or sensitive data that you disclose through any discussion boards or other public online forums hosted on the Site may be collected and used by others. PHP recommends caution when giving out personal information to others in these public online forums. When you provide information on these forums, you do so solely at your own risk. The information you share may be viewed by any other user of the Site.

What is PHP’s position on children under 16 visiting the Site?

The Site is not intended for children under the age of 16. PHP will not knowingly collect personal information from Site visitors in this age group. PHP encourages parents to talk to their children about their use of the Internet and the information they disclose online. If a child has provided PHP with personal information, a parent or guardian of that child may contact PHP via e-mail at the above e-mail address if they would like this information deleted from PHP’s records. PHP will use reasonable efforts to delete the child’s information from PHP’s databases.

Links to non-PHP Websites

The Site may contain links to websites owned and operated by unaffiliated third parties. These links are provided as a service to you, and do not constitute PHP’s endorsement or support of the third-party websites. The third parties who operate these sites have their own information collection and use practices, and PHP is not responsible for either the privacy practices or the content of these sites. When you follow a link and leave the Site, you do so at your own risk. PHP’s encourages you to review the privacy policies of each third-party site before providing your personal information, and to contact the providers directly if you have any questions about their privacy policies.

Social Media Sites

The Site may contain links to third-party social media sites, such as (but not limited to) Facebook, Instagram, Twitter or YouTube. The operators of such social media sites may collect personal information and use and disclose such information in accordance with their own privacy policies. For each such site, you should check with the site operator regarding its policies regarding the collection, use and disclosure of personal information.

International Users

The Site is hosted in the United States. If you use the Site from any region with laws governing data collection, use, and disclosure that may differ from U.S. law, please note that you are transferring your personal information to the United States. By providing personal information under this Privacy Policy, you consent to the use of personal information in accordance with this Privacy Policy and the transfer of your personal information to the United States.

The Site does not offer goods or services to data subjects in the European Union, nor does the Site monitor online behavior that takes place within the European Union.

Exercising Your Privacy Rights.

PHP has listed the privacy rights for several jurisdictions below, but PHP understands you may have additional rights in your jurisdiction. You may contact PHP directly at any time about exercising your data protection rights. PHP will consider your request in accordance with applicable laws.

Canadian Residents

Access to Information. Subject to limited exceptions under applicable law, you have the right to access, update and correct inaccuracies in your personal information in PHP’s custody and control. You may request access, updating and corrections of inaccuracies in your personal information in PHP’s custody or control by contacting PHP at the e-mail or mailing address included at the beginning of this Privacy Policy. PHP may request certain personal information for the purpose of verifying your identity when you request access to your personal information records.

Privacy Policy Supplemental Notice for California Consumers

The California Consumer Privacy Act of 2018 (CCPA) gives California residents the right to know what personal information PHP collects about them (online and offline) and whether this information is shared with third parties, as well as certain rights regarding PHP’s collection and use of their personal information. This Supplemental Notice provides the information required under the CCPA. Any terms defined in the CCPA have the same meaning when used in this Supplemental Notice.

If you are a California resident, you have the following rights under the CCPA with respect to your personal information:

Right to Notice. Before or at the time PHP collects personal information from you, you have the right to receive notice of the personal information to be collected and the purposes for which PHP uses it. This Privacy Policy and Supplemental Notice are intended to satisfy this requirement. You also have the right to request that PHP disclose to you the categories of personal information PHP has collected about you in the preceding 12 months, along with the categories of sources from which the personal information was collected, the purpose for collecting or selling the personal information, the categories of third parties with whom PHP shared the personal information, and the categories of third parties with whom PHP sold the personal information.

Right of Access. You have the right to request that PHP disclose or provide you with access to the specific pieces of personal information PHP has collected about you in the preceding 12 months.

Right to Deletion. You have the right to request that PHP delete the personal information PHP collects from you. However, in certain situations PHP is not required to delete your personal information, such as when the information is necessary in order to complete the transaction for which the personal information was collected, to provide a good or service requested by you, to comply with a legal obligation, to engage in research, to secure PHP’s websites or other online services, or to otherwise use your personal information internally in a lawful manner that is compatible with the context in which you provided the information.

Right to Opt-Out of the Sale of Personal Information. If PHP sells your personal information to third parties, you have the right, at any time, to direct PHP not to sell your personal information. To exercise this right, please contact PHP [insert link to contact page] and complete a Notification to Not Sell Personal Information as set forth below. For PHP to be able to locate your record, your message must include your name, mailing address, e-mail address, and must identify the PHP product, event, or service for which you are registered. PHP will then send you a Notification to Not Sell Personal Information, which you must complete and mail back to PHP. PHP does not sell personal information of minors under 16 years of age without affirmative authorization.

Right Not to Be Subject to Discrimination. You have the right to be free from discrimination or retaliation for exercising any of your rights under the CCPA as described above.

Exercising Your Privacy Rights. You can exercise your rights by contacting PHP here and completing a Notification to Not Sell Personal Information as set forth below. For PHP to be able to locate your record, your message must include your name, mailing address, e-mail address, and must identify the PHP product, event, or service for which you are registered. PHP will then send you a Notification to Not Sell Personal Information, which you must complete and mail back to PHP.

PHP values the security and confidentiality of your personal information. Therefore, if you exercise your right to notice, right of access, or right to deletion, PHP must first verify your identity to make sure that you are the person about whom PHP has collected personal information. PHP verifies every request carefully. Along with your request, PHP asks that you provide your first and last name, company name (if applicable), physical postal address, email address, and IP address (if you interact with the Site or PHP’s other online services, if any). You may also authorize someone else to submit these requests on your behalf. California residents who are unable to review or access this Supplemental Notice due to a disability may call PHP at 1-866-535-1452 to access this Supplemental Notice in an alternative format.

Third-Party Marketing. California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to third parties for the third parties’ direct marketing purposes. To make such a request, please contact PHP using the contact details provided above.
